In California it is a refutable presumption that a person with a BAC of 0.08% or higher is driving under the influence. However, section 23610(a)(2) of the California Vehicle Code states that driving with a BAC between 0.05% and 0.08% “shall not give rise to any presumption that the person was or was not under the influence of an alcoholic beverage”. The tragedy of these deaths is felt year-round, but for many, most strongly during the holidays. Drivers with a BAC of .08 are approximately 4 times more likely to crash than drivers with a BAC of zero. People often think they are “fine” after several drinks – but in fact, the failure to recognize alcohol impairment is often a symptom of impairment.
Alcohol
Ideally people would be identified before committing an alcohol-impaired driving offense. However, an alcohol-impaired driving arrest can be used as an opportunity to screen people for excessive alcohol use. Brief interventions involve assessing readiness, motivators, and barriers to behavior change. These interventions can be delivered in person or electronically (such as on computers or cell phone apps) in many settings, such as hospitals, doctor’s offices, and universities. Policies that make alcohol less accessible, available, and affordable are effective for reducing drinking to impairment and can also help to prevent alcohol-impaired driving. Some examples include increasing taxes on alcohol and regulating alcohol outlet density to reduce the number of retailers that can sell alcohol in a particular location.
Zero tolerance laws make it illegal for people under age 21 to drive with any measurable amount of alcohol in their systems. These laws and laws that maintain the minimum legal drinking age at 21 are in place in all 50 states and D.C. If the officer has sufficient probable cause that the suspect has been driving under the influence of alcohol, they will make the arrest, handcuff the suspect and transport them to the police station. En route, the officer may advise them of their legal implied consent obligation to submit to an evidentiary chemical test of blood, breath or possibly urine depending on the jurisdiction.
Lower blood alcohol concentration (BAC) limits
NHTSA data also reveals that men are more likely to drive drunk than women. According to 2019 FBI data, men accounted for roughly 74 percent of people arrested for drunk driving. Federal Aviation Regulation 91.17 (14 CFR 91.17) prohibits pilots from flying aircraft with an alcohol level of 0.04% or more, or within eight hours of consuming alcohol (“eight hours, bottle to throttle”), or while under the impairing influence of any drug. The same prohibition applies to any other crew members on duty aboard the aircraft (flight attendants, etc.).

This Phase also includes the post-arrest evidentiary chemical test despite that it occurs subsequent to a DUI arrest, not prior to a DUI arrest.
